Terms of Use

These Terms of Use ("Terms") govern your access to and use of BeFound AI (the "Service"), operated by Payani Media LLC ("BeFound," "we," "us"). By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BeFound AI analyzes how AI search engines and assistants surface a website, produces a visibility score, and provides automated improvements, including AI-generated content and a WordPress plugin that can publish and modify content on a website you connect. The Service evolves, and features may be added, changed, or removed.

2. Eligibility and accounts

You must be at least 18 and able to form a binding contract. You are responsible for your account, your credentials, and all activity under your account. You agree to provide accurate information and to keep it current.

3. Subscriptions, billing, and cancellation

Paid plans are billed in advance on a recurring basis through our payment processor. By subscribing you authorize recurring charges until you cancel. You may cancel at any time, effective at the end of the current billing period. Except where required by law, payments are non-refundable and partial periods are not prorated. We may change pricing with notice; changes apply to the next billing period.

4. AI-generated content

The Service uses artificial intelligence to generate text, images, and recommendations. AI output can be inaccurate, incomplete, or unsuitable, and may not reflect current facts. You are solely responsible for reviewing, editing, and approving any content before it is published, and for the content that is published to your site, including its accuracy, legality, and compliance with any professional, advertising, or industry rules that apply to you. We do not warrant that AI-generated content is accurate, original, non-infringing, or fit for any purpose.

5. Site access, publishing, and your responsibilities

If you install our plugin or connect your website, you authorize the Service to read, create, modify, and publish content and settings on that site to provide the features you enable. You are responsible for maintaining current backups of your site and data. We are not responsible for, and you release us from, any loss, downtime, broken layouts, plugin or theme conflicts, data loss, or other issues arising from the plugin or from publishing to your site. You may disable automation or remove the plugin at any time.

6. No guarantee of results

We do not guarantee any specific outcome, including search rankings, citations or mentions by AI engines, traffic, leads, bookings, or revenue. Results depend on many factors outside our control.

7. Acceptable use

You will not use the Service to publish unlawful, infringing, deceptive, or harmful content, to violate the rights of others, to interfere with the Service, or to process sites you are not authorized to manage.

8. Intellectual property

You retain ownership of your site, your data, and the final content you publish. We retain all rights in the Service, the platform, and our underlying technology. You grant us a limited license to process your data and content solely to provide the Service.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, BeFound and Payani Media LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

11. Indemnification

You will indemnify and hold harmless BeFound and Payani Media LLC from any claim or liability arising out of your content, your use of the Service, your site, or your violation of these Terms or any law or third-party right.

12. Termination

We may suspend or terminate access for violation of these Terms or for risk to the Service or others. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in California, and you consent to their jurisdiction.

14. Changes

We may update these Terms. Material changes will be communicated, and continued use after changes take effect constitutes acceptance.
